DMCA Policy

Alcovia, Inc. ("Company," "we," "us") respects the intellectual property rights of others and expects users of the Alcovia platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. Section 512, we have adopted this policy for addressing claims of copyright infringement related to content on or generated through the Service.

If you believe that content available on or through the Alcovia platform infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent. Your notice must include the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., a URL or specific description)
• Your contact information, including your name, mailing address, telephone number, and email address
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Upon receipt of a valid DMCA takedown notice, we will:

• Promptly remove or disable access to the allegedly infringing material
• Notify the user who posted or generated the material that it has been removed or disabled
• Provide the user with information about how to submit a counter-notification if they believe the removal was made in error

We aim to process valid DMCA notices within 5 business days of receipt.

If you believe that material you posted or generated was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we will restore the removed material.

In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are repeat infringers of copyright. A "repeat infringer" is a user who has been the subject of more than two valid DMCA takedown notices. We reserve the right to terminate accounts after a single instance of infringement in egregious cases.

Alcovia's AI engine generates design visualizations based on user inputs, reference images, and trained models. If you believe that an AI-generated output infringes your copyright (for example, if it reproduces a copyrighted design, pattern, or image), you may submit a DMCA notice as described above. We will investigate the claim and take appropriate action, which may include modifying our AI models to prevent future similar outputs.

We handle all DMCA notices and counter-notifications in good faith and in accordance with applicable law. We do not make determinations regarding the merits of copyright disputes between parties. If a dispute cannot be resolved through the DMCA process, we encourage the parties to seek resolution through mediation, arbitration, or the courts.
